Terms and Conditions

1. This agreement

These Terms and Conditions are a binding agreement between you and Delete My Face ("we", "us", "our"), governing your use of the Delete My Face iPhone app and this website (together, the "Service").

By downloading, opening or using the Service you accept these terms. If you do not accept them, do not use the Service. Our Privacy Policy is part of this agreement.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service. By using it you confirm that you meet that requirement and that you have the legal capacity to enter into this agreement.

3. What the service is

Delete My Face does two distinct things.

• Visibility. It transmits the photo you scan to a third-party reverse face-search engine and shows you what that engine returns: images from the public web that resemble the face, each with a confidence score.
• Protection. It provides step-by-step guides for requesting removal from the major reverse face-search engines, so that a face search is less likely to surface you in future.

Delete My Face is an interface to that engine. We do not operate the search index, and we do not store your photo or your results on our servers.

A free preview runs on your device so you can see how the app works before buying anything. A full scan requires a scan credit.

4. What the service is not

We would rather set expectations correctly than win a sale and disappoint you. Please read this section carefully.

The Service is not legal advice, not an identity verification tool, not a background check service, and not a consumer reporting agency. You must not use results from the Service for any purpose governed by the Fair Credit Reporting Act, such as decisions about employment, housing, credit or insurance.

5. Your account

The Service creates an anonymous account on first launch so your scan credits can be held securely. You do not need to give us a name or an email address. Your account is tied to your device and your Apple ID purchase history.

You are responsible for the device you use. If you delete your data or uninstall the app, on-device scan history is gone and cannot be recovered by us, because we never had it.

6. Acceptable use

You agree that you will not:

• Use the Service to identify, locate, monitor, stalk, harass or investigate another person.
• Use results to harm, threaten, embarrass or discriminate against anyone.
• Reverse engineer, decompile or tamper with the Service.
• Attempt to manipulate scan credits, subscriptions or entitlements.
• Use automated means to access the Service, or resell access to it.
• Use the Service in violation of any applicable law.

Breaking these rules is a material breach and we may suspend or terminate your access immediately and without refund.

7. Credits and subscriptions

Scan credits

A full scan consumes one scan credit. Credits can be bought as a one-time purchase or come included with a plan. Credits have no cash value, are not transferable, and are not redeemable for money.

Auto-renewable subscriptions

• Plans are offered as auto-renewable subscriptions billed through your Apple ID.
• Payment is charged to your Apple ID at confirmation of purchase.
• A subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected.
• You can manage or cancel a subscription in your Apple ID account settings at any time.
• Cancelling stops future renewals. It does not retroactively refund the current period, and access continues until that period ends.

Prices

Current prices are shown in the app before you buy, in your local currency. We may change prices for future purchases and renewals. Where the law requires it, we will give you notice and the chance to cancel before a new price applies.

8. Refunds

All purchases are processed by Apple, so refunds are handled by Apple under the Apple Media Services Terms and Conditions. Request one at reportaproblem.apple.com. We cannot issue refunds directly.

If a scan fails for a technical reason on our side, the credit is returned to your balance. If that does not happen, email help@deletemyface.com and we will put it right. A scan that runs successfully and returns few or no matches has still been performed, and is not treated as a failed scan.

Nothing here affects statutory rights you may have under local consumer law.

9. Removal guides and third-party sites

The Service includes instructions for opting out of third-party services, and links to those services. We do not control them, we are not affiliated with them, and their processes can change without notice. We work to keep the guides current but we do not warrant that they are complete or accurate at any given moment.

Naming a third-party service in a guide is not an endorsement, and is not a statement that we have any relationship with it. Your use of any third-party site is governed by that site's own terms.

10. White-glove service

A concierge removal service may be offered in future. It is a real-world service performed by people, it is not sold through in-app purchase, and it is not active today. Joining the waitlist is not a purchase and creates no obligation on either side. If we launch it, it will have its own separate terms.

11. Intellectual property

The Service, including its software, design, text and branding, belongs to us and is protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, in line with the App Store Terms of Service.

You keep all rights in the photos you submit. You grant us only the limited licence needed to process an image in order to run the search you asked for, as described in the Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.

We specifically do not warrant that:

• scans will find every image of you, or that every result is genuinely you;
• any removal or opt-out request will be granted, or granted in any timeframe;
• your face will stay out of any index after a successful removal;
• the Service will be uninterrupted, timely or error free.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Service.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or 50 US dollars.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

14. Indemnity

You agree to indemnify and hold us harmless from claims, damages, losses and reasonable legal costs arising out of your misuse of the Service, your breach of these terms, or your violation of anyone else's rights.

15. Termination

You can stop using the Service at any time, delete your data in Settings, and uninstall the app. We may suspend or terminate access if you breach these terms, if we are required to by law, or if we discontinue the Service. Sections 4, and 11 through 17, survive termination.

If we discontinue the Service entirely, we will give reasonable notice and, where practical, refund unused prepaid credits.

16. Apple

This agreement is between you and us only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app.

If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory compliance, or intellectual property claims.

Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

You represent that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.

17. General

If any provision of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it.
